On December 18, 2020, FinCEN released a notice of proposed rule-making (the “NPRM”) setting forth proposed regulations to expand the U.S. anti-money laundering rules on virtual currency. Financial institutions sometimes struggle with how to bank clients that provide virtual asset services. Virtual currencies are sometimes exchanged for U.S. dollars or other currencies around the world, but they are not currently backed nor supported by any government or central bank. Many financial institutions have clients that purchase virtual currency, are miners, exchangers and other participants in a virtual currency chain.
